At Bonhomie México, we are committed to delivering high-quality, comprehensive solutions in graphic design, marketing, advertising, audiovisual production, and web development. To ensure transparency and build trust with our clients, we have established the following Sales and Refund Policies, applicable to all products and services within the United States of Mexico.
1. General Terms of Sale
- 1.1. Currency: All prices are quoted in Mexican Pesos (MXN), the legal tender of the United Mexican States, unless otherwise expressly stated in the corresponding quote or contract. Prices include applicable taxes in accordance with current tax laws.
- 1.2. Foreign Currency: If a different currency is indicated, the applicable exchange rate will be clearly specified at the time of contracting or payment, following the guidelines set by the Bank of Mexico (Banco de México).
- 1.3. Price Adjustments: Bonhomie México reserves the right to modify prices, promotions, or sales conditions without prior notice. These changes will not apply to purchases that have already been confirmed.
- 1.4. Formalization: Service agreements or product acquisitions are considered formal once the initial deposit (down payment) is received and the corresponding quote or contract is signed.
2. Payment Methods
- 2.1. Accepted Methods: We accept payments via bank transfer, over-the-counter deposits, credit or debit cards, and, in specific cases, through secure digital payment platforms.
- 2.2. Initial Deposit: A minimum 50% deposit of the total amount is required to begin any work, unless a different written agreement is established.
- 2.3. Balance: The remaining balance must be settled according to the timelines established in the specific quote or contract.
3. Delivery and Timelines
- 3.1. Agreed Deadlines: Delivery times will be established by mutual agreement in each contract, considering the specific nature of the project.
- 3.2. Client Responsibility: Bonhomie México is not responsible for delays caused by the client, such as failure to provide necessary information, materials, approvals, or payments in a timely manner.
- 3.3. Shipping: For printed or physical products, shipping times are subject to the terms of the selected courier or logistics provider.
4. Cancellations
- 4.1. Notice: Clients may cancel a contracted service at any time by providing written notice to Bonhomie México.
- 4.2. Cancellation Fees:
- If the project has not started, a 10% administrative fee of the total amount will be retained.
- If the project is already underway, the initial deposit will not be refunded. However, a partial delivery of the work completed to date may be negotiated.
5. Refunds
- 5.1. Eligibility: In accordance with the Federal Consumer Protection Law, clients are entitled to request a refund only in the following cases:
- Overcharges or duplicate charges.
- Delivery of a product or service different from the one contracted.
- Verifiable failure to meet agreed deadlines without a justified cause.
- 5.2. Change of Mind: Refunds will not be granted for changes of mind or internal client decisions once the project has commenced.
- 5.3. Processing: When applicable, refunds will be processed within 15 business days following a favorable resolution and will be issued through the same payment method used for the original transaction.
6. Warranties
- 6.1. Intangible Services: Creative, technological, and audiovisual services provided by Bonhomie México are intangible in nature. Therefore, standard warranties for physical goods do not apply.
- 6.2. Adjustments: We are committed to making reasonable adjustments to deliverables (designs, video assets, websites, etc.), provided they fall within the original scope and revision rounds specified in the initial quote or contract.
7. Invoicing (Tax Receipts)
- 7.1. Requests: Clients must request their tax invoice (factura) within the same month the payment was made, providing complete and accurate tax information.
- 7.2. Accuracy: Bonhomie México is not responsible for invoicing errors resulting from incorrect data provided by the client.
- 7.3. Global Invoicing: If an invoice is not requested in a timely manner, the transaction will be included in the company’s “Global Invoice” in compliance with Mexican tax regulations.
8. Consumer Protection
- 8.1. PROFECO: Clients may contact the Federal Consumer Protection Agency (PROFECO) to file complaints or claims if they believe their rights have been violated.
- 8.2. Legal Compliance: Bonhomie México operates at all times in full compliance with the Federal Consumer Protection Law and other applicable regulations.
9. Travel Expenses and Per Diem
- 9.1. Out-of-Area Projects: For projects requiring services outside the Guadalajara Metropolitan Area, the client is responsible for all travel expenses and per diems for Bonhomie México staff.
- 9.2. Coverage: Travel expenses include, but are not limited to: transportation (land or air), lodging, meals, and local transit necessary for project execution.
- 9.3. Management: These expenses can be managed in two ways, via prior written agreement:
- Directly by the Client: The client handles all reservations and payments for transport and lodging according to agreed standards.
- Pre-Approved Budget: Bonhomie México will provide an estimated travel budget to be settled alongside the project’s initial deposit.
- 9.4. Delays: Any logistical delays or failure to cover travel expenses that prevent the service from being performed on the agreed date will be the client’s responsibility and may be subject to rescheduling fees.
